Types of Services Provided by Lyft

Unlike a taxi, hailing a Lyft ride requires downloading an app onto your smartphone, and using the app to request a ride. The app connects the passenger to the Lyft driver, who uses GPS to locate the passenger, and take him or her to the requested destination.

Lyft offers different levels of service, including:

  • Lyft Standard — The lowest cost Lyft service, for up to 4 people in a standard 4-seat sedan
  • Lyft Line — Matches riders traveling in the same direction, who share the ride and the cost, which means a cheaper price
  • Lyft Lux — Premium black car service, limited to luxurious makes and models
  • Lyft Lux SUV –Premium black SUV service for parties with up to six passengers
  • Lyft Plus — For larger groups of 6 passengers or more traveling together
  • Lyft Premier — Super luxury service in a high-end 4 seat vehicle

Lyft and other rideshare services have become popular for many reasons, including the fact that a Lyft ride is typically less expensive than a taxi. Moreover, Lyft vehicles are privately owned by drivers, and tend to be newer, cleaner and more comfortable than taxis. Lyft drivers respond to passenger requests quickly, and take passengers to their exact destination. Finally, because the fare is paid through the app, the entire transaction is safe, convenient, and seamless.

Who is liable in a Lyft accident in California?

Depending on the circumstances, Lyft or the Lyft driver can be held liable for an accident that results in injuries, however, obtaining obtaining coverage depends on whether (1) the Lyft driver was logged onto the app and being connected to a passenger, (2) a ride had been accepted and the Lyft driver was en route to retrieve the passenger, or (3) the passenger was in the Lyft vehicle and being taken to his or her destination.

If the app is off, the Lyft driver’s personal insurance is in force and must meet the minimum auto insurance requirements in California ($15,000 bodily injury coverage per person, $30,000 of bodily injury coverage per accident, and $5,000 of property damage coverage per accident)

If the rideshare app is on, but the Lyft driver has not been connected to a passenger, the driver must have additional coverage:

  • $50,000 bodily injury liability coverage per person injured in an accident
  • $100,000 of bodily injury liability coverage per accident
  • $30,000 of property damage liability coverage per accident

During this period, Lyft is also required to provide additional $200,000 on liability insurance. Once a passenger has secured a ride and entered a vehicle, however, Lyft must carry a mandatory minimum of $1 million in automobile insurance, which will be the primary coverage for damages.

Given the fact that rideshare drivers are independent contractors, however, Lyft may attempt to deny any liability for the errors of its drivers. Moreover, Lyft coverage may not be sufficient to cover damages arising from serious injuries, in which case it will also be necessary to look to the Lyft driver’s policy for coverage.  Ultimately, a Lyft accident claim may involve more than one party — Lyft’s insurer, the driver’s insurance carrier, or other drivers and their insurance carriers.
