The charm of its restaurants and small shops is well-known. Idyllic though it may sound, however, even Santa Rosa has its share of personal injuries due to traffic accidents, slip and falls, and even dog bites. California is known as a statutory strict liability state which means that the owner of a dog is strictly liable for any dog bite from the moment that ownership begins. Some exceptions to this rule apply, such as when the victim was:
- Provoking the dog
- Injured by his employer’s dog while working
- Performing a paid service involving the dog
- Engaged in a criminal act and being apprehended
- Protecting its owner or another person
It should be noted that the provocative statute does not apply when the victim under 5 years of age. Also, there are particular statutes under California that apply to a “potentially dangerous dog.” Such a dog is defined as having, during the past 3 years:
- Engaged in any behavior requiring defensive action to prevent injury
- Without provocation bitten an individual, causing severe injury
- Without provocation attacked another domesticated animal
Unlike many other states, California does not have a “one bite” law. The dog’s owner is liable for damages even the very first time the dog injures someone, whether the dog has ever demonstrated aggressive behavior previously or not. In situations in which mail delivery personnel are attacked, the owner is typically considered liable.
Why You Need J&Y Law at Your Side during a Dog Bite Case
The complexity of dog bite laws is one reason it is invaluable to have a personal injury attorney on your side when dealing with such a case. Another is that there are time constraints involved both in reporting the dog bite incident and in filing the lawsuit.
Surprisingly, the majority of victims injured by dogs are injured by dogs they know, even dogs belonging to family members. This is also a good reason to consult with an attorney who understands all aspects of the law and can help sort things out so that there is not undue stress on close human relationships because of an action taken by a pet.
If you or a family member has suffered any serious injury as a result of the negligence of another in the Santa Rosa area, you should contact J&Y Law personal injury practice where you are assured of being treated with kindness, professionalism and respect.
