Two Active Revival Windows Give Adult Survivors More Time to File
California currently has two separate revival windows open under California Code of Civil Procedure § 340.16. They operate independently, cover different circumstances, and close on different dates.
The AB 2777 Window — Closes December 31, 2026
The Sexual Abuse and Cover-Up Accountability Act, signed by Governor Newsom on September 19, 2022, applies to survivors who were 18 or older at the time of the assault, where the assault occurred on or after January 1, 2009, and where the civil claim would otherwise be barred. For actions commenced on or after January 1, 2019, such claims may be commenced until December 31, 2026. This window applies to claims against individual perpetrators and against institutions, without requiring an allegation of a cover-up.
Two conditions block revival under AB 2777: the claim was litigated to a final judgment before January 1, 2023, or it was resolved through a written settlement before that date. If neither condition applies, the claim may still be filed before the window closes.
The AB 250 Window — Closes December 31, 2027
California Assembly Bill 250, signed by Governor Newsom on October 13, 2025, and effective January 1, 2026, created a separate two-year revival window for time-barred adult sexual assault claims involving private institutions. To qualify, a survivor must allege that one or more entities are legally responsible for damages arising out of the assault, and that an entity — including its officers, directors, representatives, employees, or agents — engaged in, or attempted, a cover-up of a previous instance or allegations of sexual assault by the alleged perpetrator.
AB 250 also revives claims against the individual perpetrator when brought alongside qualifying entity claims. Failure to allege a cover-up as to one entity does not bar claims against other entities or the perpetrator — each defendant is evaluated independently. Entity claims still require the plaintiff to satisfy the full statutory allegations, including legal responsibility and a cover-up or attempted cover-up by at least one entity.
AB 250 expressly excludes claims against public entities. Claims resolved by final judgment before January 1, 2026, or by written settlement before that date, cannot be revived under AB 250.
What Both Windows Have in Common
Neither window requires a prior criminal conviction, criminal charges, or a police report. The civil standard of proof — that the assault more likely than not occurred — is lower than the criminal standard of proof beyond a reasonable doubt. A civil case can move forward regardless of whether a criminal prosecution was ever filed or resulted in a conviction.
The baseline statute of limitations for adult sexual assault civil claims under CCP § 340.16(a) remains 10 years from the date of the last act, or three years from the date the survivor discovered a resulting injury or illness, whichever is later. Both revival windows operate on top of that baseline for claims that had already expired. If your claim is still within the standard deadline, no revival statute is required.
