Determine Who Is Liable for Your Whiplash Injury
California law places a duty on every driver to keep a safe distance from the vehicle ahead. Vehicle Code Section 21703 requires drivers to avoid following another vehicle more closely than is reasonable and prudent given speed, traffic, and road conditions. A driver who rear-ends you in traffic has usually broken that duty, and this can support a car accident negligence claim against them.
Liability is not always limited to the driver who hit you. If the at-fault driver was working at the time, driving a delivery van or a commercial vehicle, their employer may share responsibility under California’s rules for employer liability. This is common in rideshare accident claims, where the insurance coverage that applies changes depending on whether the driver was logged into the app and whether a passenger was already in the vehicle at the time of the crash. California Civil Code Section 3294 sets a high bar for punitive damages: you must show clear and convincing evidence that the driver acted with malice, oppression, or a conscious disregard for the safety of others.
