Can I sue for personal injury if I get hit by a car while inside of a building?
Some people drive to the nail salon in a panic over a broken nail. Others drive through the nail salon, causing panic and injuries in the wake of the car accident.
Apparently, it’s not enough to worry about being involved in a California pedestrian accident while walking the streets. Now, you may not even be safe once you’re inside a store.
But if you are injured due to the actions of someone else, you may be able to recover damages in a personal injury lawsuit.
Recently, a woman allegedly drove her car through the glass store front of a San Diego nail salon, not stopping until the vehicle was fully inside the building. The apparently unintentional accident happened mid-morning near a liquor store, but early indications did not indicate that alcohol was likely a factor in the crash. Reportedly, the driver and one other person– who was unlucky enough to have been in the nail salon at the time of the crash– were injured. In addition, a local fire department spokesperson reported that “minimal structural damage” was sustained to the storefront salon.
Post-accident investigations are important in establishing liability, which determines who has standing to sue and what damages they can reasonably seek to recover. Car accidents can be caused by many factors including driving under the influence of drugs or alcohol, sudden illness of a driver, distracted driving, aggressive driving, mechanical errors, poor weather, and more. In order to recover, you must prove the other person was responsible for your injuries.
If you are injured as a result of the negligence, recklessness, or malice of another person, you may be entitled to compensatory damages in a personal injury lawsuit. Once liability is established, recoverable damages may include the cost of medical treatment, future medical expenses, lost income and future diminished or lost wages, property damage, pain and suffering, and more depending on the circumstances.
