Injured in a Hit and Run? Know Your Rights!

What’s worse than being injured in a car accident? When the driver who is at fault speeds off, leaving you in pain and with questions about who is going to pay for your injuries. If you are the victim of a hit and run car accident, you likely have many questions about your options for compensation and justice. In California, motorists involved in accidents which result in injury or death to another individual are required to stop and remain at the scene until law enforcement authorities arrive. Often, this involves calling 911 or otherwise contacting law enforcement authorities. Finally, when law enforcement arrive, the driver at fault must provide information to them including their name, address, and vehicle registration information.

If a driver leaves the scene, it obviously make it more difficult to obtaining compensation for your injuries. Unfortunately, these drivers are sometimes not found. However, here are some helpful tips that can maximize the chances that the driver is found:

  • If you are able to, try to focus on characteristics of the car, the driver, any passengers, or the license plate. Sometimes it helps to repeat the information to yourself until law enforcement arrive. If you are able to write it down on paper or on your phone, do so immediately so you do not forget.
  • If your injury does not prevent you from doing so, try to flag down, approach, or otherwise get the attention of any witnesses to the accident. Ask them to describe to you what they saw, or to write it down or put it in a note on their phone immediately. Make sure to get their contact information and name.
  • Once law enforcement arrive, make sure they talk to you and any witnesses, and that they get your and any witnesses’ contact information. The more information you can give them about the car, the better your chances that the driver will be found.

If the driver is found, you are likely able to bring a personal injury car accident claim against them for injuries you suffered, medical expenses, and any pain and suffering the accident caused you. Further, the fact that they left the scene of the accident typically bolsters any claim you make against them or their insurance company.
