Facts about Dog Bites in California

California is known as a statutory strict liability state which means that the owner of a dog is strictly liable for any dog bite from the moment that ownership begins. Some exceptions to this rule apply, such as when the victim was:

  • Trespassing
  • Provoking the dog

  • Performing a paid service involving the dog
  • Engaged in a criminal act and being apprehended

It should be noted that the provocative statute does not apply when the victim under 5 years of age. Also, there are particular statutes under California that apply to a “potentially dangerous dog.” Such a dog is defined as having, during the past 3 years:

  • Without provocation attacked another domesticated animal

Unlike many other states, California does not have a “one bite” law.
